A pedestrian accident is when a vehicle collides with a pedestrian. It’s essentially a 3,000-pound mass of steel and aluminum crashing into the body of a person. The pedestrian is not protected by the cage of a car. There’s a lot more potential for broken bones and for some severe spine injuries and also for traumatic brain injuries. And so their body is just put in a situation that it wasn’t built to withstand. It’s easier to explain to a jury, for example, why someone is so badly hurt in a vehicle on a pedestrian collision. The challenging part is that sometimes these collisions can occur at low speeds. There’s not even a scratch on the car. The person is badly hurt, and that’s when it becomes tricky. The inference that the defense and the insurance companies try to create is if you are a pedestrian, and the collision with the vehicle didn’t cause any harm to the vehicle, then how can it be that you are so badly hurt?
