A driver is responsible for seeing you. A driver is responsible for being 3 feet away from you when they pass you. They have to safely pass you. They cannot use a flimsy excuse. “Oh, I’m sorry. I didn’t see the cyclist. They’re not as big as a car.” Whatever. No, you have to watch for cyclists, for wheelchairs, for children, for dogs. The driver is responsible for absolutely paying attention and accepting that responsibility for driving safely at all times. So that applies to cyclists who are entitled to the same protection as everyone else.
