Certifying a Class
Typically, a court must approve a class action, which is called “class certification.” The judge is looking to see that all the workers bringing the lawsuit have similar claims.
Consider a typical wage and hour dispute: Your employer refused to pay for the 10 minutes every morning you spend setting up a coffee shop and sweeping the floors. These 10-minute increments really add up and probably cost you hundreds of dollars at the end of the year.
Suppose the business had a company-wide policy of not paying for this work. In that situation, hundreds of other workers in all the stores around California are likely affected. Because your claims are similar, a judge will probably certify the class and allow the class action to move forward.
However, a judge wouldn’t certify a class if one person is claiming harassment or sex discrimination and others are alleging denial of overtime pay. Those claims are too dissimilar to be joined into a class action.
An experienced class action wage & hour claims lawyer is a big help in ensuring that your class gets certified. Defendants often fight certification because they want individual workers to have to bring their own separate lawsuits. They find it easier to win that way.
