What Is an Employment Class Action and How Are They Handled?

Class actions are ways to collectively help a group of people who have been wronged in terms of how they were paid or some other condition of their employment. Individual actions help the one client that we have. What we call representative actions can be class actions or they can be what’s called a PAGA claim. These are claims where we represent many employees who have been subject to the same violation.

In those situations, the client comes to us, and we recognize that this harm, this failure to pay or provide some employment benefit, has happened to a whole class of people, not just our client. If that group or class is large enough and if the violations are common enough, then we’re able to have our client be a representative, whether it’s for a class or for a group of employees under PAGA. We are able to then help a large group of people recover the wages or work benefits that the employer failed to pay.
