Family Sues San Diego Lifeguard for Wrongful Death After Rip Current Incident

The family of an 18-year-old swimmer has filed a wrongful death and negligence lawsuit against the city of San Diego and one of its lifeguards. The lawsuit claims that the lifeguard directed the swimmer toward a lifeguard tower without warning him about a dangerous rip current in the area, which ultimately led to his drowning.

On June 14, the decedent was swimming at Mission Beach with a friend when he was directed into the rip current by a lifeguard on a jet ski. Despite being aware of the hazardous conditions, the lifeguards allegedly failed to warn the public about the rip current. The swimmer followed the lifeguardโ€™s instructions, only to be swept into the ocean by the current, where he tragically drowned.

Though authorities have found remains, they have not confirmed if they belong to the decedent, as the remains have yet to be identified.

Alleged Lifeguard Negligence in Fatal Drowning Incident

The lawsuit contends that the lifeguardโ€™s failure to warn the swimmer about the rip current represents negligence, violating the expected duty of care in similar situations. Had the swimmer been properly informed of the danger, the tragic accident could have been avoided. The city of San Diego is being held liable for the actions of their employee, the lifeguard, who directed the swimmer into the hazardous area.

The family seeks compensation for the wrongful death of their son, who had his entire life ahead of him before the tragic incident.
