Lawsuit Filed Over Deadly Truck Accident Involving Rear-End Collision

TrucksCars

Rear-end collisions involving semi-trucks are a major concern in the United States. Such accidents account for a substantial number of truck accidents on American highways. Statistics gleaned from the National Highway Traffic Safety Administration indicate that around 29 percent of all truck accidents involve rear-end collisions. Meanwhile, the Federal Motor Carrier Safety Administration estimates that about 23.1% of all commercial truck accidents involve rear-end collisions. Why?

Semi-trucks stop much more slowly than your average commercial vehicle. Truck drivers who drive too fast, follow too closely, fail to pay attention to the road, or are otherwise distracted while driving can fail to stop in time, resulting in serious injuries to the drivers and passengers of the cars they slam into. The sheer size and weight of these vehicles can absolutely destroy smaller vehicles. Often, motorists are killed by semi-trucks that fail to stop in time at red lights, in slowed traffic, or in work/construction zones.

Truck slams into the back of four vehicles stopped at a red light

A personal injury truck accident lawsuit has been filed in connection with a deadly crash in Thomasville, Alabama, recently. Two people died while several others were seriously injured after investigators say an 18-wheeler plowed into four vehicles that were stopped at a red light on U.S. 43. The plaintiff is suing the trucking company and its driver over the accident. She alleges that her SUV flipped over and caught fire. Two people pulled her to safety shortly after the collision, likely saving her life.

The driver of the semi-truck, Andrii Dmyterko, a resident of Philadelphia who police say is in the U.S. on a work visa, has been charged with two counts of vehicular manslaughter. Attorneys for the plaintiffs say that dash cam footage indicates that the driver never even attempted to stop.

Causes of truck accidents in the U.S.

  • Driver fatigue – Truck drivers are required to take periodic rest breaks to avoid accidents caused by fatigue. These rest breaks are logged. When the truck driver violates the law, they can cause serious accidents like the one mentioned above.
  • Driving too fast – Large commercial trucks roll slowly to a stop. Speeding can increase the risk of a rear-end collision.
  • Distracted driving – Drivers playing on their cell phones increase the risk of causing a serious accident.
  • Following too closely/tailgating – Large commercial trucks cannot stop on a dime. Truck drivers need to maintain a distance from the car in front of them.
  • Drug or alcohol intoxication – Some truck drivers drive their rigs under the influence of alcohol or drugs.
  • Defective maintenance – Maintenance failures can result in serious accidents, causing injury or death, especially tire blowouts.
